This privacy policy explains the use of personal data processed by HERMAN.

HERMAN is a webshop that sells clothes and related products, including its own clothing line and home accessories.

We process personal data under the General Data Protection Regulation (GDPR) with respect to our activities. This policy explains how we handle your personal data.

By using our services, you agree to this privacy policy. By agreeing to this privacy policy, you consent to the processing of your personal data in the manner set out in this policy. This Privacy and Cookie Policy does not apply to websites operated by other organisations which we link to and we are not responsible for any personal information sent by you through HERMAN to these third parties.

WHOSE PERSONAL DATA ARE RECEIVED BY US

We receive personal data mainly from you, as you provide these personal data when ordering in the HERMAN webshop. We also collect information about website traffic, wish lists and other commercial information used to map consumer patterns, which we use for internal research, marketing purposes and to adapt our website to better meet our customers’ requirements.

 

PURPOSES AND PROCESSING OF PERSONAL DATA

  1. When placing an order, your name and telephone number, address and e-mail address are recorded. These data are necessary for us to provide the most effective service.
  2. For promotional and marking purposes. For example, sending newsletters and for promotions and competitions.
  3. Cookies, Google Analytics or Google Ads and so on allow us to track what visitors do on our website. This allows us to improve our website and services and enhance our responsiveness to visitors’ needs. Data may be processed for this purpose, such as the web page visited, click and browsing behaviour, the duration of your session.
  4. We are active on social media. If you contact us via social media, we may process your name, email address or social ID, which will enable us to contact you or answer your query. When contacting our customer service by email or phone, data are searched in the system which facilitates us in finding a solution quickly.
  5. We process your payment details to enable us to process your payments in our records.
  6. We process the letters, CVs and correspondence of job applicants. After the end of the application procedure, these data will be deleted within 4 weeks. If we wish to keep an applicant on file, we will inform the applicant accordingly. We keep an applicant on file for a maximum of 1 year.
  7. No more personal data are collected than necessary for the stated purposes. If the data are not retained for those purposes, we may still retain the data in order to keep them in our records and for legal purposes and limitation periods.

 

BASES OF PROCESSING

We process personal data that are:

  1. necessary for the performance of our agreement
  2. processed with explicit consent
  3. processed pursuant to a statutory obligation
  4. necessarily processed for proper business operations, such as processing insurance data
  5. necessary to protect clients’ vital interests.

 

Other parties

HERMAN will not sell or rent personal data to third parties. Your personal data will only be shared with third parties with your consent, or when sharing is necessary for the performance of services. These data are necessary with respect to the performance of the agreement. In addition, we may share personal data if required by law or when necessary for proper business operations or the protection of health and safety. An example is the disclosure of customer data to government agencies in order to prevent and combat fraud.  If you pay by iDeal, your details are stored in our records which enables us to easily process any returns.

 

OTHER PARTIES

Adequate technical and organisational measures are taken by HERMAN in order to secure personal data against loss or against any form of unlawful processing. These measures provide an appropriate level of security considering the specific risks posed by the processing and the nature of the data to be protected, and with due allowance for the state of the art and the costs of implementation. The measures also aim to prevent unnecessary collection and further processing of personal data.

 

RETENTION OF DATA

HERMAN retains personal data during the provision of services, or as long as necessary for other purposes. Personal data may be retained after the end of the agreement on account of tax retention periods (keeping admin records), statutory expiry periods (the law states that a claim can be filed within a certain period of time) or with legal retention periods.

 

YOUR RIGHTS

Upon request, you can access your personal data or request its deletion or modification, you can request to be forgotten or request the restriction of personal data. Besides, you may withdraw your consent. Your request should be implemented as soon as possible, and no later than within 30 days.

You may object to the use of your personal data if it is used for purposes other than those agreed or stated in this policy. In addition, you have the right to file a complaint with us or with the Personal Data Authority.
